On September 28th, 2025, 1, D/S Mathis, with the Jackson County Sheriff' s Office, was dispatched to 3380 Caverns Rd,, Marianna, FL. The call was in reference to numerous 911 complaints about a black male walking down Caverns Rd naked. Callers also stated they saw the subject carrying a black baseball bat. Upon my arrival, I made contact with the subject at the above-listed address. I observed the subject to indeed be completely naked. As I exited my patrol car, the subject began to avoid me by walking into the roadway. I began to follow him while brandishing my department-issued taser. While following him, I shouted loud verbal commands to get on the ground, but the subject would not stop walking and did not say anything back. Due to the suspect being armed and in the public roadway, I fired my taser, striking him in the back. The suspect fell to the ground, and he was taken into custody without incident. Once the suspect was in custody, 1 began to ask him why he was naked and why he had the baseball bat. The suspect was completely silent and would not speak to law enforcement. Note that the suspect was not wearing a single piece of clothing. Other officers on scene recognized the subject due to prior interactions, and they informed me that his name was Aceain Nicholson. This was confirmed by utilizing photographs via NCIC/FCIC.
EMS responded and transported him to Jackson Hospital, he was medically cleared and transported to the Jackson County Correctional Facility to await his first appearance.
In conclusion to my investigation, I determined that Aceain was in violation of Florida State Statute 877.03 (Breach of Peace), due to his corrupting public morals and interrupting the sense of public decency, in view of multiple witnesses. I also found that he was in violation of the Florida State Statute 800.03 (1)(a) (Exposure of sexual organs), due to him exposing his sexual organs in public in an indecent manner. And concluding that he was also in violation of the Florida State Statute 843.02 (Resisting without violence), due to the subject's refusal to get on the ground after I gave him lawful commands. This incident did occur in Jackson County; all body-worn camera footage in relation to this incident will be uploaded to evidence.com.
