The ordinance prohibits certain commercial trucks, defined as Regulated Trucks, from traveling on non-designated city streets within Marianna unless they are traveling to or from a specific destination such as a delivery point or the driver's residence.

Definition of “Regulated Truck”

A “Regulated Truck” is any vehicle that meets one or more of the following:

• Has six or more tires, excluding step-vans and pickups with a capacity of one ton or less.

• Is required by law to display a DOT number or gross vehicle weight (GVW) rating.

• Has a Gross Combined Weight Rating (GCWR) or Gross Vehicle Weight Rating (GVWR) over 10,000 lbs.

• Requires the driver to hold a Commercial Driver’s License (CDL).

• Is hauling hazardous materials.

Where Regulated Trucks Can Travel

Regulated Trucks must use only designated commercial vehicle routes. These are typically major roads like:

• U.S. Highway 90 / State Road 10 (Lafayette Street)

• Jefferson Street / Caverns Road / Hwy 166

• Hwy 73 N and S

• County Road 276 (Penn Ave / Kynesville Road)

A full list of roads closed to commercial truck traffic is included in the ordinance.

Exceptions.

Regulated Trucks may use non-designated streets only if:

• They are traveling to or from a specific local destination, such as making a delivery or heading to their residence.

• They follow the shortest route possible to minimize travel on local roads.

• They are an emergency vehicle or are on a detour authorized by the City.

Hazardous Materials

Trucks carrying hazardous materials are prohibited from using local City or County streets unless necessary for a delivery or worksite within the city.

Enforcement

• Police officers or designated code enforcement personnel may issue citations.

• Drivers deviating from truck routes must provide evidence of their destination (e.g., logbooks or delivery slips).

• Fines:

o First offense: $100

o Second offense: $200

o Third or subsequent offenses: $300
